UK Home Secretary Sets Settlement Timelines Ranging From Three to Thirty Years
Shabana Mahmood's new rules tie the duration required for permanent residence to income, occupation, and visa history, with specific adjustments for social care workers.

The British government has finalized a framework that divides migrant settlement periods into five distinct tiers, ranging from three to thirty years. Home Secretary Shabana Mahmood announced these changes following a wide consultation process, a move designed to align permanent residence rights with individual economic contributions and visa compliance.
The shortest timeline of three years applies to high earners making over £125,141 who pay the additional rate of tax. It also covers highly skilled migrants on specific routes such as Global Talent and Innovator Founder. A five-year period applies to those earning over £50,271 who pay the higher rate of tax, skilled public sector workers including doctors, nurses, and teachers, and refugees who arrived via government safe and legal routes.
For the majority of other migrants earning below those income thresholds, the standard waiting period is now ten years. This tier also includes refugees who did not arrive by small boat and are currently working or studying. A twenty-year timeline applies to migrants who claim certain benefits or commit visa offenses. It also covers refugees who arrived by small boat but are now employed or in education, as well as those who did not arrive by small boat but are not currently working or studying.
The longest period of thirty years is reserved for refugees who arrived by small boat and are not currently working or studying. Mahmood stated the policy aims to be fair to both those who contribute to the system and British citizens who should not face a greater burden.
A notable revision concerns social care workers who arrived on a care visa between the pandemic and May of last year. If they met their visa conditions and earned at least £25,000 annually, they can now settle after five years. Approximately one quarter of this group arrived through companies that sponsored them for jobs that did not exist.
Those specific workers who failed to meet visa conditions due to faulty sponsorship are eligible for a new five-year visa. To qualify, they must secure a job offer within 120 days. If they cannot find a secure job within that window, they will be required to leave the United Kingdom.
